M&M’S® ICE CREAM FUNSURANCE SWEEPSTAKES OFFICIAL RULES

1. PROMOTION DESCRIPTION: M&M’S® Ice Cream Funsurance Sweepstakes (the “Sweepstakes”) begins on 7/17/24 at 12:00:00 AM Eastern Time (“ET”) and ends on 8/10/24 at 11:59:59 PM (ET) (the "Promotion Period"). The Promotion Period includes a qualifying purchase period which begins on 7/17/24 at 12:00:00 AM (ET) and ends on 8/9/24 at 11:59:59 PM (ET) (“Qualifying Purchase Period”). Participation in the Sweepstakes does not constitute participation in any other promotion, contest or sweepstakes. By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Mars Wrigley Confectionery US, LLC (“Sponsor”), which shall be final and binding in all respects.

2. ELIGIBILITY: Open to legal residents of, and residing in, the fifty (50) Unites States and District of Columbia who are eighteen (18) years of age or older at the time of entry. Employees, officers, and directors of Sponsor, its parent company, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies and each of their respective officers, directors and employees (collectively with Sponsor, "Promotion Entities") and each of their immediate family members (e.g., spouse, parent, child, sibling, and their respective spouses and the “steps” of each, regardless of where they reside) and persons living in the same household of each, whether or not related, are not eligible to enter or win. All applicable federal, state, and local laws apply. Void where prohibited or restricted by law.

3. HOW IT WORKS:
There are two (2) ways to enter the Sweepstakes:

A) With Purchase: During the Qualifying Purchase Period,

• BUY any one (1) of the following M&M’S® Ice Cream Cookie Sandwich products - M&M’S® Cookie Sandwich with Vanilla Ice Cream (4 ct. box, 8-ct. box and 12-ct. box); M&M’S® Cookies and Cream Ice Cream Sandwich (4-ct. box and 12-ct. box); M&M’S® Cookie Sandwich with Chocolate Ice Cream (4 ct. box); M&M’S® Cookie Sandwich with Vanilla Ice Cream (single – 1-ct.); M&M’S® Cookies and Cream Ice Cream Sandwich (single - 1-ct.); M&M’S® Cookie Sandwich with Mint Ice Cream (single – 1-ct.); M&M’S® Cookie Sandwich with Chocolate Ice Cream (single – 1-ct.) (collectively, “ Participating Products”) at participating retail stores in the U.S. (each a “ Qualifying Purchase”). Note: Product returns/exchanges and rainchecks from before the Promotion Period do not constitute a Qualifying Purchase and will not qualify as an entry into this Sweepstakes;
• TAKE a picture of your entire receipt showing Qualifying Purchase, go online to www.mmsicecreamfunsurance.com (“Website”), complete the registration process as instructed, then UPLOAD the picture of your receipt in order to complete the entry process. Receipt upload for purchase entry submission must be completed by the end of the Promotion Period. ANY RECEIPT SUBMISSIONS UPLOADED AFTER THE END OF THE PROMOTION PERIOD WILL NOT BE ACCEPTED, EVEN IF PURCHASE WAS MADE DURING QUALIFYING PURCHASE PERIOD AND IS OTHERWISE IN COMPLIANCE WITH THESE OFFICIAL RULES. Data rates may apply for submissions made via mobile device. Check with your wireless service provider for any applicable rates and fees. Only Qualifying Purchases are valid for this Sweepstakes. Photo must include the entire receipt from top to bottom, including all four (4) corners. Be sure that the required information is captured in the receipt, which includes retailer name, date of purchase, time of purchase, receipt total and at least one (1) Participating Product/UPC code (“Required Information”). All Required Information must be legible in your image(s). For longer receipts, you may submit a picture of the receipt folded ensuring that it shows the Required Information. Blurry and/or unreadable receipt images will be rejected. Star the Qualifying Purchase on your receipt for quicker verification. ALL SUBMISSIONS ARE SUBJECT TO VALIDATION BY SPONSOR; IF SUBMISSION IS NOT VALIDATED, YOU WILL NOT RECEIVE AN ENTRY. For help, visit www.mmsicecreamfunsurance.com. Receipts that are sold, traded, auctioned, altered, modified or otherwise obtained through illegitimate channels will be void.
• GET one (1) entry into the Sweepstakes for each receipt that includes at least one Qualifying Purchase that is uploaded in compliance with these Official Rules once your receipt is validated, subject to the entry limitations stated below. For the avoidance of doubt, any receipt can only be used once. If there are multiple Participating Products included on a single receipt it will be considered one (1) Qualifying Purchase and you will only receive one (1) entry into the Sweepstakes.

B) Without Purchase: During the Promotion Period, you may also enter the Sweepstakes without making a purchase by sending a handwritten 3” x 5” piece of paper containing your full name, date of birth, address, city, state, zip code, daytime phone number, and email address (if available) in a handwritten envelope with sufficient postage affixed to: M&M’S® Ice Cream Funsurance Sweepstakes, P.O. Box 4006, Dept. S9373, Grand Rapids, MN 55730-4006. Mail-in entry must be postmarked by 8/10/24 and received by 8/17/24.

Limit one (1) purchase entry per person, per receipt with a Qualifying Purchase. Each receipt with a Qualifying Purchase will only count as one (1) entry in the Sweepstakes. Each Qualifying Purchase must be submitted on a separate receipt in order to be eligible for an entry in the Sweepstakes. Limit one (1) No Purchase entry into the Sweepstakes for each mail-in entry received. Each mail-in entry submitted and received must be in a separate outer stamped mailing envelope. Released Parties (as defined below) are not responsible for lost, late, misdirected, illegible, incomplete, invalid, damaged, stolen, postage due or mutilated mail. Entries received in excess of or in violation of the stated limitations will be void. Any attempted form of entry into the Sweepstakes, other than the entry methods stated, is prohibited.

4. RANDOM DRAWING: Potential winners will be selected in a random drawing on or about 8/19/24 from among all eligible entries received from all methods combined by Sponsor or its designee.

5. WINNER NOTIFICATION: Potential winners will be notified by email and/or phone, using contact information provided or collected at the time of entry. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by a potential winner for any reason. If, despite reasonable efforts, a potential winner does not respond within three (3) days of the first notification attempt, or if the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, or a potential winner declines the prize or is not in compliance with these Official Rules, such potential winner will forfeit the prize and an alternate winner may be selected. Sponsor, in its sole discretion, will attempt to contact up to two (2) potential winners of a prize in accordance with the above procedure, after which the prize in question may go unawarded if it remains unclaimed.

6. PRIZE/APPROXIMATE RETAIL VALUE (ARV)/ODDS: Twenty-five (25) Grand Prizes are available. Each Grand Prize consists of $250 (awarded in the form of a check to the winner). Total ARV of all prizes $6,250. Unclaimed prizes may not be awarded. Odds of winning depend on total number of eligible entries received. All applicable federal, state and local taxes on prize are the sole responsibility of the prize winner. No substitutions or transfer of prize permitted except that Sponsor reserves the right to substitute a prize of comparable or greater value. All prize details are at Sponsor’s sole discretion. Limit one (1) prize person/household.

7. PUBLICITY GRANT: Acceptance of a prize shall be construed as and signify the winner’s agreement and consent that Sponsor and its designees may use the winner’s name, voice, likeness and/or prize information in any and all media now known or hereafter devised throughout the world, in perpetuity, without additional compensation or consideration, review, approval, notification or permission, unless prohibited by law.

8. GENERAL CONDITIONS: By participating in this Sweepstakes, entrants agree to be bound by the Official Rules and the decisions of the Sponsor, which are final and binding in all respects. If for any reason the Sweepstakes (or any portion thereof) is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes; and award the prizes from among all eligible non-suspect entries received from all methods combined up to the action taken by the Sponsor provided a sufficient number of eligible entries have been received or as otherwise deemed fair and appropriate by Sponsor. Caution: Any attempt by any person to deliberately damage any website or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent of the law.

9. LIMITATIONS AND RELEASES: By entering Sweepstakes, entrants agree to release and hold harmless Promotion Entities and the directors, officers, employees, assigns of each of the foregoing (collectively, “Released Parties”) from and against any claim or cause of action arising out of participation or attempt to participate in the Sweepstakes or receipt or use of any prize. Released Parties are not responsible for lost, late, mutilated or illegible entries nor for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware, software, electronic, network, telephone or other communications malfunctions, errors or failures of any kind, errors in transmission, lost or unavailable network connections, telephone connections, wireless phone connections, website, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture or entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed transmissions which may limit or restrict an participant’s ability to enter the Sweepstakes, including any injury or damage to participant’s or any other person’s device, or other matter relating to or resulting from participating in this Sweepstakes or downloading any materials in the Sweepstakes. Released Parties are not responsible for other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes.

10. PRIVACY: Except as may be otherwise contemplated in these Official Rules, any personal information collected in connection with this Sweepstakes will be used in accordance with the Sponsor’s privacy policy found at mars.com/privacy.

11. DISPUTES: THIS SWEEPSTAKES IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF NEW JERSEY, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN WARREN COUNTY, NJ. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JAMS IN ACCORDANCE WITH ITS ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”). THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN NEW JERSEY. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN HACKETTSTOWN, NJ. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL OR INCIDENTAL DAMAGES OR HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED, INCLUDING BUT NOT LIMITED TO ATTORNEYS’ FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF. POTENTIAL WINNERS AGREE THAT THE RIGHTS AND OBLIGATIONS OF ANY POTENTIAL WINNER AND/OR PROMOTION ENTITIES AND/OR ANY OTHER PARTY SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORTING TO ANY FORM OF CLASS ACTION. ANY DEMAND FOR ARBITRATION MUST BE FILED WITHIN ONE (1) YEAR FROM THE END OF THE SWEEPSTAKES, OR THE CAUSE OF ACTION SHALL BE FOREVER BARRED.

12. WINNERS’ LIST: For names of winners, send a self-addressed, stamped envelope by 10/20/24 to: M&M’S® Ice Cream Funsurance Sweepstakes, Attn: Winners’ List, P.O. Box 930175, Wixom, MI 48393-0175. Winners’ list to be available after 8/20/24.
